René Fouché Incorporated is a specialist law firm based in Rosebank, Johannesburg.

What is Personal Injury?

Personal Injury is defined as any injury sustained by a person to the physical body or the psychosoma caused by a deliberate or negligent act of a person, company or the State (National, Provincial or Local Government).  It covers a variety of fields, including motor vehicle accidents, medical malpractice, train accidents, assaults, unlawful arrest, dog bites and injuries sustained in public spaces (falling objects, defective construction of buildings and “slip and fall” injuries).

Biographies

René Fouché

René Fouché entered the legal profession more than three decades ago.

He has a commercial background, and exposure to labour related issues, but found his niche in the field of personal injury. Mr Fouché acted for a number of large corporations and the Road Accident Fund, but now acts exclusively for victims of:

  • Motor vehicle accidents
  • Assault/wrongful arrest
  • Birth injuries
  • Medical negligence
  • Aviation accidents
  • “slip and fall” cases

He has extensive experience in short term and long term insurance law, having acted for Southern Life, Santam, Guardian National, Auto and General, General Accident and others.

Mr Fouché’s  proficiency in the identification of subtle manifestations of brain injuries has earned him the respect of colleagues and medical professionals.

He introduced the unique concept of ‘aftercare’, and has a dedicated team providing ongoing support, counselling and guidance for individuals where required after finalisation of the client’s case.

Jasper Le Roux

Jasper started his career in law at the Department of Justice, where he was introduced to the machinations of justice and the effect thereof on individuals – good and bad.

He was approached by a leading litigation firm and took up a position as candidate attorney.  He was introduced to René Fouché (a director at the firm) and was exposed to personal injury matters, acting on the part of Defendants.  His passion for forensic investigations was ignited, his skill in conducting thorough and comprehensive investigations was enhanced, and he received superior training in chamberwork.

Jasper joined René Fouché, after the latter commenced practicing for his own account, and his focus then changed – acting exclusively for individuals against the Road Accident Fund, insurance companies and large public institutions (the public health sector has gained a reputation for incompetency and Jasper enjoys representing victims of the malpractice frequently committed at State hospitals).

The experience gained in the days when he acted for insurance companies with deep pockets is invaluable and enhances Jasper’s flair in acting for individuals, where no stone is left unturned in the thorough investigations and dedicated chamberwork required to formulate and quantify a claim.  His skills were honed by exposure to talented Counsel (Senior and Junior) from the inception of his professional career.

Jasper takes instructions from prospective clients and he utilises his forensic talents, during the initial assessment, to identify subtle symptoms of obscure injuries – supported and guided by our gifted team of medical experts.

Deon Smith

From the inception of his career, Deon’s focus has been litigation.

He served articles, gaining wide experience, before joining the Road Accident Fund in order to add another string to his bow – specialist knowledge of the law of personal injury.  Deon had the benefit of exposure to the best (and to sub standard) practitioners, and now applies many valuable lessons learnt with regard to the effective and efficient prosecution of personal injury claims.

Naturally, Deon’s flair for litigation was honed following his appointment at a leading litigation firm and his regular appearances at the High Courts on behalf of the Defendant (Road Accident Fund) served to enhance his skills – Deon commanded the respect of friend and foe alike as his preparation, attention to detail and ability to negotiate has become his touchstone.
